1. Agreement to These Terms

We respect intellectual-property rights. If you believe material on the Site infringes your copyright or other intellectual-property rights, email admin@myfinalpolicy.com with enough information for us to identify the material and evaluate the claim, including your contact information, a description of the work, a description of the allegedly infringing material, a statement that you have a good-faith belief that the use is not authorized, and a statement that the information is accurate and that you are authorized to act for the rights owner.

We may remove or disable access to material that we believe may infringe intellectual-property rights and may terminate repeat infringers where appropriate.

13. Disclaimer of Warranties

15. Indemnification and Release

You agree to defend, indemnify, and hold harmless myfinalpolicy.com and its affiliates, owners, officers, directors, employees, contractors, agents, licensors, service providers, vendors, advertisers, business partners, and participating providers from and against all claims, demands, losses, damages, liabilities, judgments, settlements, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use or misuse of the Site, your User Submissions, your violation of these Terms, your violation of law, or your violation of any third-party right.

To the fullest extent permitted by law, by using the Site, you release myfinalpolicy.com and its affiliates, owners, officers, directors, employees, contractors, agents, licensors, service providers, vendors, advertisers, business partners, participating providers, and related persons and entities from any and all claims, demands, causes of action, proceedings, liabilities, obligations, damages, costs, and expenses, whether known or unknown, arising out of or related to your use of the Site or dealings with third parties found through the Site.

If you are a California resident, you waive California Civil Code Section 1542 to the fullest extent permitted by law. Section 1542 provides that a general release does not extend to claims that the releasing party does not know or suspect to exist in the releasing party's favor at the time of executing the release and that, if known, would have materially affected the settlement with the released party.

16. Dispute Resolution, Arbitration, and Class Action Waiver

Please read this section carefully. It affects your legal rights. To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to the Site, Content, communications, Third-Party Services, these Terms, or your relationship with myfinalpolicy.com will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court if the claim qualifies.

The arbitration will be administered by a neutral arbitration provider under its applicable consumer arbitration rules. The arbitration will take place in Lehi, Utah, by telephone, by video conference, by written submissions, or at another mutually agreed location or format. The arbitrator may award relief only on an individual basis and only to the extent necessary to resolve the individual claim.

You and myfinalpolicy.com agree that each may bring claims against the other only in an individual capacity and not as a plaintiff, class member, private attorney general, or representative in any class, consolidated, representative, collective, or mass action. If a court or arbitrator determines that any part of this arbitration or class-waiver section is unenforceable as to a particular claim or remedy, that claim or remedy may be severed and brought in court, and the remaining provisions will continue to apply to the fullest extent permitted by law.

17. Governing Law

These Terms and any dispute arising out of or relating to them or the Site will be governed by the laws of the State of Utah, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement where applicable.

18. Changes to the Site and Terms

We may modify, suspend, or discontinue the Site, Content, features, forms, offers, or these Terms at any time, with or without notice. The updated Terms will be posted on the Site with an updated effective date. Your continued access to, viewing of, submission through, or use of the Site after updated Terms are posted constitutes your acceptance of the updated Terms.

19. Termination

We may suspend, restrict, or terminate your access to the Site at any time and for any reason, including if we believe you violated these Terms, created risk, submitted inaccurate information, interfered with the Site, or used the Site unlawfully. Sections that by their nature should survive termination will survive, including intellectual-property, privacy, disclaimers, limitation of liability, indemnification, release, dispute-resolution, governing-law, and miscellaneous provisions.

These Terms, together with our Privacy Policy and any additional terms that apply to a specific service, form, promotion, or transaction, constitute the entire agreement between you and myfinalpolicy.com regarding the Site. If any provision is found invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce a provision is not a waiver.
